Cross-border waste transfers: changing the rules of the game
The new Waste Shipment Regulationwill enter into force on Monday, 20 May, however,its implementation will be effectiveonlyfrom 21 May 2026with a few exceptions.
Here is what we can remember from this publication:
- From 20 May 2024,information procedures for intra-EU shipments of wastewill be dematerialized. These will also have to be signed by all companies involved in the transfer. In practice, where the person organizing the transfer is not the waste producer, he or she must have the information procedure accompanying the shipment signed.
- From 21 May 2026,Fuels Solid Recovery (CSR), including household waste, production waste or industrial waste, can no longer be exported outside the European Union, including to OECD member countries.
- As from 21 May 2026,plastic waste classified under code B3011and exported outside the EU, will have to be subject to a notification procedure rather than information. Furthermore, as with the hazardous waste listed in Part 1 of Annex V to Regulation (EU) 2024/1157, the export of waste classified under Code B3011 to countries where the OECD Decision does not apply will no longer be possible from 21 November 2026.
- From 21 May 2027, if you wish to exportnon-hazardous waste to non-OECD countriesIt will be necessary to ensure that the country of destination has been previously authorised by the European Union to receive this waste for recovery. A country wishing to receive such waste must submit an application by 21 February 2025.
The recovery and disposal of non-firmly regulated waste is the source of disastrous environmental and health consequences. With this new regulation, Brussels hopes to affirm its willingness to take the necessary measures.
