Morocco: BDU regulations applicable from 1 January 2025
In 2020, Law No. 42-18 on the control of the export and import of dual-use goods, civil and military, and related services, was enacted in Morocco. In order to streamline the application of this new regulation, Morocco has decided to start by controlling exports of certain goods and technologies.
To this end, a new decree was published in the Official Gazette on 22 October 2024. As from 1 January 2025, export licences for products subject to these regulations are mandatory. However, a transitional phase of three months has been mentioned in the regulatory text due, inter alia, to the delay in obtaining a licence of up to two months.
In the event of non-compliance with these new rules, legal, financial or reputational sanctions may be imposed on the basis of non-compliance.
For the time being, the entry into force of this regulation only affects exports. However, imports into Morocco will also be affected in the near future.
