The zero deforestation principle of Regulation (EU) 2023/1115 will apply in six months
Regulation « zero deforestation » The aim is to ensure that products consumed by EU citizens do not contribute to deforestation or forest degradation worldwide. On the other hand, the subject also concerns exports from Community territory.
The products currently covered by the regulation are cattle, cocoa, oil palm, rubber, soy, wood and their derivatives.
The principle of mandatory declaration to be issued on a Community portal from the Single Window before importing, exporting or selling on the Community market was retained. That declaration, referred to as « Statement of due diligence« , will have to be declared admissible by the European information system and passed on to distributor customers on the market. This declaration must be kept for a period of 5 years.
In France, the two competent authorities on this subject are the Ministry of Ecological Transition and Cohesion of the Territories and the Ministry of Agriculture and Food Sovereignty. The customs administration shall be responsible for verifying that the products concerned, whether imported or exported, have been duly declared.
The customs positions of the products concerned by the Regulation are detailed in Annex I to the Regulation.
The information to be included in the due diligence declaration is detailed in Annex II to the Regulation.
Overall, the declaration should include:
- the name, address and EORI number of the operator
- details of the products concerned and quantities, usually expressed in kilograms net mass
- the country of production and the geolocation of the parcels from which the products are derived, these parcels must be recognised by the EU as « zero deforestation » Since 31 December 2020.
Operators will be able to refer to an already existing due diligence declaration by quoting the reference number of the declaration.
Articles produced before 29 June 2023 as well as SMEs are not covered by the subject, defined by Directive 2013/34/EU (usually less than 250 employees).
