ICS2: a step forward in securing European freight

ICS2 is an advanced cargo information platform based on data exchange to detect potential risks or frauds prior to the arrival of the goods in customs.

In order to optimise the exchange of risk information between the customs authorities of the Member States and the Commission, a number of provisions have been implemented. These include the relaxation of certain provisions of the EU Customs Code, the increased involvement of the carrier, as well as specific directives for transit to Ukraine and the temporary importation of packaging.

The ICS2 system was broken down into three successive steps:

  • Thefirst phase, which began on15 March 2021, concerns certain express freight companies and postal operators operating on air cargo. This phase concerns only the search for aviation security risk
  • Thesecond phaseannounced30 June 2023will concern postal operators, express freight companies and air carriers*, which will have to send a full pre-arrival ENS declaration to the European central database (the data to be provided in the ENS entry summary declaration are more numerous and must come from all economic operators)
  • Thethird phase, which will begin on1 June 2024, will concern other modes of transport such as maritime, rail, road and river. During this period, the ICS1 rules will continue to apply to these vectors.

*For the aircraft, three essential elements should be noted: the harmonised HS code at a minimum of 6 digits for each item in the consignment, a precise description for each item in the consignment and the EORI number of the consignee.

In parallel, several amendments were made by the European Commission to the EU Customs Code to facilitate the deployment of the ICS2. These changes include the new definition of the third party postal operator, the addition of the multi-deposit procedure for Phase 3 of the ICS2, and changes to verbal customs declarations for the temporary importation of packaging.

Its full deployment is scheduled for 1 June 2024 in France.

If you wish to delay the requirement of this obligation, you can request an exemption from the DGDDI by writing your application to the addressfr-ics2@douane.finances.gouv.fr before 30 June 2023. This derogation may be granted until 2 October 2023.

Your request should include the following information:

  • the name of your company and its EORI number
  • quality as a declarant of the ENS (Commissionaire de transport / House level spiner)
  • the requested deployment window « from JJ/MM/2023 to JJ/MM/2023 » (maximum date being 02/10/2023)
  • the planned launch date.
