CITES Convention: Amendments in force since 21 May 2023

The European Commission published Regulation (EU) 2023/966 on 15 May to update Regulation (EC) No 338/97**. This update aims to formalize the decisions taken at the CITES Convention CoP19*Convention on International Trade in Endangered Species of Wild Fauna and Flora, held in Panama City from 14 to 25 November 2022.

These include:addition and suppression of certain animal and plant speciesin various annexes to the Convention.

Changes in annotations andchanges in the interpretation of annexeswere also carried out.

Finally, CoP19 has made changes in the species nomenclature. Several species and subspecies have changed their names. Others have been included in Annexes I and II to the Convention following these changes in nomenclature, requiring their respective inclusion in Annexes A and B to the European Regulation.

As a reminder, compliance with this regulation at Community level is the responsibility of the customs administrations which verify at the time of clearance the presentation of authorisations according to the various annexes:

*CITES :

  • Annex I: lists the most endangered species. Trade in these species is strictly regulated or even prohibited.

  • Annex II: contains species which are not necessarily threatened with immediate extinction but whose trade is controlled to avoid any negative impact on the species concerned

  • Annex IIIincludes species that are protected in at least one country that has requested assistance from other CITES parties to control trade.

**For the EU (Regulation (EC) No 338/97) :

  • Appendix A: equivalent of CITES Annex I. These are the most threatened species, for which trade is most strictly controlled. It also includes certain species of CITES Annex II and III for which the European Union has adopted stricter protection measures.

  • Appendix B: corresponds largely to Appendix II of CITES. It also includes certain species of CITES Annex III and species not listed by CITES but regulated within the EU.

  • Appendix C: includes in Appendix III of CITES. These species are protected in at least one country outside the EU that has requested EU assistance to control trade.

  • Appendix D- includes species not listed in CITES but for which the EU has chosen to monitor trade in order to measure its impact on the conservation status of these species.
