Independent tariff quotas and REACH compliance: Customs expands its scope of control!

Community manufacturers may find themselves in the situation of having to import raw materials or components for which there is no production in the European Union.
In this case, they have the opportunity to apply for import tariff suspensionunder the procedure for issuing Autonomous Tariff Quotas (ATC).
In order to do this, industrialists must submit to the competent national authorities a seriously substantiated application file: in France, this is the case.DGDDI who is in charge of processing cases.
The guidelines for this very specific regulation have been published in OJ EU C363, 13 December 2011.
In the case where the file is accepted by the Community administration, the authorisation is issued for a period of 5 years.
Note
Once the autonomous tariff quota is opened, it can be used by all operators wishing to benefit from it: the original applicant cannot claim exclusive use of the CTA.
The European Commission has recently communicated on this subject to warn operators of an amendment to the application form: it has been adapted to allow customs authorities to also assess compliance with theREACH Regulation goods claiming CTA.
