EU/Turkey Customs Union: reminder of ATR movement certificates
On 6 March, the French Customs requested a regulatory reminder concerning theATR movement certificatesused in the framework of the Customs Union between the European Union and Turkey.
In force since 1995, this customs union allows, between these two territories, thefree movement of goodsmanufactured in EU or Turkey,orinitially imported from third countries and released for consumption (writing of customs duties).
Forproof of free movementbetween these two territories, an ATR movement certificate must be used. This documentdoes not constitute proof of origin. It is therefore necessary to keep in parallel the declarations and proofs of origin of goods originating in Turkey within the meaning of the customs regulations in order to be able to provide them in case of customs controls.
It should be noted that ifIndustrial products(excluding ECSC products and agricultural products listed in Annex 1 to the Treaty on the Functioning of the EU) concerned by the Customs Union may benefit from an exemption from customs duties on entry into the EU, other trade measures (such as anti-dumping duties and additional duties) remain due.
With regard to the reminder by the Customs Service, the following points were particularly highlighted:
- evidence of the free movement of goods (documents to ensure the manufacture of the goods in the EU or copies of customs declarations attesting to their release for consumption) must be providedsystematically provided to the customs service,
- when the ATR certificate application is made by your RDE (Representative in Registered Customs), it must bewith a term of office of representationat the time of deposit,
- only ATR certificates containing themention « FRANCE »in box 5 are covered by French customs,
- ATR certificates issued by Turkey which include the expression « Community » in box 4will no longer be accepted after 31/03/2024.
