Update of the Frequently Asked Questions on the European Commission website

On 24 October, the European Commission confirmed, via the Online Frequently Asked Questions dedicated to MACF, the flexibilities granted at national level for the data to be reported by the end of the transitional period.

In the abundant flow of communications concerning the MACF (Carbon Adjustment Mechanism at the Frontiers), the European Commission has just clarified some points addressed by DGEC (Directorate-General for Energy and Climate) at its webinar on 16 October (cf.MACF: Terms of application for the status of authorized registrant).

The recent update of the MACF Frequently Asked Questions confirms that national authorities responsible for monitoring the accuracy of quarterly reports must take into account thesanctions measuresif the reports are not complete. As it stands, the national authorities are asked to assess thelevel of sanctions based on evidenceimporters demonstrating their unsuccessful efforts to collect accurate data from their suppliers. The European Commission also confirms the possibleflexibilitiesannounced by the DGEC in relation to the size and volume of the imports of companies which fail to give the real values (see question 75, paragraph 9) but also according to the demonstration of the repeated efforts on the part of the companies (e.g. attach the stimulus letters sent to suppliers and remained unanswered).

The procedures for applying for MACF status (question 113) and the evolution of the calculation methods under analysis at European level are also discussed. On the latter point, it is recalled that the aim is to develop theformulas that are as simple as possibleTaking into account the workload of establishing the MACF for importers (question 126).

As a reminder, the report to be filed on October 31 can no longer be set at 100% on default values. These values may represent a maximum of 20 per cent of emissions only for complex goods, i.e. for which emissions of incoming materials must be reported for processed products.

If you have not yet filed your report and have not obtained the exact emission values from your suppliers, your only option is to establish a relationship with zero values and attach to it all the evidence of your unsuccessful actions (cf.MACF: the key points for your next report!).
