Professional packaging: declaration of re-use to be made before 30 April 2024

Under the system for monitoring the re-use of professional packaging, companies placing more than 10 000 units of packaged products on the French market each year must make an annual declaration. If you are concerned, for the year 2023, this procedure must be carried out from 15 February and before 30 April 2024.

The AGEC (Anti-Waste for a Circular Economy) Act of 10 February 2020 set targets for the proportion of packaging reused to be placed on the market annually over the period 2023-2027, with the aim ofreach 10% of re-used packaging in 2027. Re-used packaging means packaging which has been used for at least a second use. The DecreeNo 2022-507 of 8 April 2022provided clarification to put this regulation into practice.

Thus, from 2023 onwards, allproducer, importer, distributorplacing on the French marketmore than 10,000 units of packaged productsper year is subject to a re-use obligation and must make an annual declaration of its packaging data as early as 2024. Logistics platforms are also impacted if they condition products in packaging for shipping orders. All packages placed on the market in France are covered, all materials combined. Packages of exported products are not to be recorded.

Companies placing packaging on the market which is not supported by a REP (Enlarged Producer Responsibility) sector will have to complete a declaration themselves to the Re-use and Re-use Observatory led by the ADEME (Environmental Transition Agency) which will be available in the form of:online questionnairefrom 15 February 2024. This declaration must be made no later than 30 April 2024. This is a transitional solution for the year 2024, pending the establishment of the REP lines for all packaging.

The declaration must be entered by a structure identified by a SIREN for all its establishments. It will be responsible for indicating its majority sector of activity and the total amount of industrial and commercial packaging put on the market in 2023 and the proportion of packaging re-used. If the producer can justify that a packaging has been placed on the market abroad at least once before it is placed on the market in France, he can count it as a re-used packaging.

The requirements are different depending on the company's annual turnover. It should be noted that for 2023, although many companies are subject to reporting, only those with an annual turnover of more than EUR 50 million are required.respect a proportion minimum5 % re-used packaging.
