ATR certificates: the latest clarifications confirmed by the Customs Directorate

On Wednesday, 24 April, Customs publishes a Note to Operators to confirm the supporting documents to be produced during the ATR visa as well as updates to the form.

Last March, we shared with you information on the establishment of ATR certificates and their formalism applicable on 1 April 2024 (see:EU/Turkey Customs Union: reminder of ATR movement certificates)

Some questions remained outstanding and the Customs wished to answer them very precisely. The summary of the note is as follows:

  • ATRs covered by Turkish Customswith the entry « EEC »in box 4no longer valid since 1 Aprildate of the document. In other words, it isdate on Turkish Customs stampthe date of customs clearance in France.
  • The ATRs covered by the French Customswith the entry « EU » in box 4 are not valid butremain authorised by derogation until 31 December 2024to dispose of stocks of certificates.
  • French ATRs referring to the EECremain allowed until the text of Decision 1/2006 changes; In fact, a translation error in the text misleaded publishers, the customs will keep operators informed of the update of the text.
  • The visa for certificates is subject to theproof of the free movement of goods in the EU/Turkey Customs Union. As a result, French operators must be able to supply the declaration of import for a third party or proof of manufacture in the EU at the earliest opportunity.

Last clarification concerning ATRs established by Customs Representatives Registered on behalf of French exporters: a representation mandate must be signed by the customer.
