Dual Use Goods: Update of the list of products concerned and Report 2022

As a reminder, theDouble use goods(BDU) are so-called sensitive goods (materials or intangibles, equipment, technologies, software, knowledge or know-how) because of their specific characteristics, intended for civilian or military purposes. In order to prevent their diversion from their strictly regulated and legal use, for an illegitimate use that may contribute to the proliferation of weapons of mass destruction, their export is subject to state control.

In December 2022, for the first time, the Ministry of Economy, Finance and Industrial and Digital Sovereignty published a report on exports of Dual Use Goods.*. This document indicates that the total amount of individual licences granted for the BDUs in 2021 wasEUR 9 billion.

On 11 January 2023, Regulation 2023/66, published in the Official Journal of the EU, established, as in its annual habit, the list of goods considered as Dual Use Goods. The update again increases the list, particularly in the category ofelectronic products, communication and information security systems. Thespecific softwareIt is also used in the biology and chemistry sector.

Customs strongly recommends prior determination of the classifications of the products to be exported in this list, subject to penalties, penalties, customs blockades on shipments to third countries and within the Community territory. Alternatively, it is imperative to contact the Double Use Property Service (DUSB), the only entity competent to determine whether the goods require a specific licence or authorization before export. The SBDU usually processes applications within 3 weeks. Each licence application is reviewed on a case-by-case basis and involves geopolitical, economic, industrial and technical expertise of the members of the Interdepartmental Commission.

The licensing process, from receipt of the application to notification of decisions, is carried out by the SBDU in a dematerialised way through the information system « EGIDE » (Registration and Interdepartmental Management of Export Files).
