Trade agreements: EU triggers higher speed...

This position follows a recent decision of the Court of Justice of the European Union clarifying the Union's competence in commercial matters, allowing it to without ratification of national parliaments.

All the issues negotiated under a free trade agreement now fall within the exclusive competence of the European Union. with the exception of certain investment or intellectual property provisions.

It will therefore be possible in the future to split trade agreements into two parts to prevent the treaties from being stopped by a single national or regional Parliament, as has happened recently for CETA (cf. International atmosphere of February 2018).

However, this new management of the agreements will not be without problems for the future partner countries. Indeed, the conclusion of the agreement on the first part (trade negotiations) does not guarantee the ratification of the second part (investments and intellectual property)... What could weakening the Community position in bilateral negotiations.

That is why Brussels stresses that this new approach should be seen as an option And not as an obligation...
