Paneuromed zone: the countdown is launched before the implementation of the modernised rules!

At the beginning of the year, simplified rules were issued concerning the operation of cumulation of origin in the Pan-Mediterranean area and the updating of the possibilities of cumulation in that area (seePaneuromed : update of the matrix for cumulation of origin in the zone).

As a reminder, the aim of simplifying the rules is to maintain the competitiveness of near-import producers in the face of competition from Asian countries by offering each part of the area the opportunity to feed raw materials for production in neighbouring countries by simplifying management rules and related documents. Indeed, once all parties have ratified the modernised rules, the EUR-MED proof of origin will disappear in favour of the only EUR1 proof or, in its dematerialised version, by the Declaration of Origin on Invoice (DOF).

At one month of the entry into force of the simplified rules, many regulations appear in the official newspapers legalizing adherence to the modernised rules and the permeability of these rules with the historical rules for countries that have updated their preferential agreements protocols.

What we must remember today:

Each acceding country of the zone shall introduce the revised rules into the bilateral protocols and adopt the principle of permeability of the rules. The idea is to be able to use in parallel the original rules of both versions. Let us take a specific example to highlight our point: a Swiss manufacturer will claim a preferential origin with the revised rules on a finished product while its basic component of EU origin will have obtained its EU origin under the historical rules of the Paneuromed Agreement. It will then be able to apply Paneuromed preferential origin and establish a EUR1 or a DOF indicating the application of cumulation for the export of its product to another member of the area which has acceded to the revised rules. This « mixing » was not possible until now.

Attention, not all countries have yet updated their protocols with simplified rules of origin. New information should emerge before the end of the year to confirm or not the generalisation of the rules on 1 January 2025.
