PANEUROMED area: what changes for imports from Morocco and Tunisia
While on the last day of 2025 the end of historical rules of origin must have been brought to an end in favour of fully harmonised rules throughout the PANEUROMED area, the European Commission published on 31 December, OJEU 2025/2664 officializing the confirmation of Morocco's acceptance of the new rules.
The Regulation announces rules for « substitution » which are other than rules « transitional arrangements » or called « Modernized ».
Morocco has yet to update the original convention on its side through the publication of an Official Bulletin and gives itself until 31/12/2027 to do so. In the meantime, the so-called transitional rules will therefore apply to define the origin of products manufactured in Morocco or in the EU for trade between the two parties.
The new Regulation details the revised rules of origin, which may be more advantageous or, on the contrary, more restrictive than the historical provisions. Certain sectors, such as vegetable oils and certain tobacco products, are particularly affected. In this context, Morocco negotiated the maintenance of the old, more favourable rules in the form of quantitatively limited preferential tariff quotas.
As from 1 January 2026, new preferential quotas shall be opened for the products listed in Appendix B to the Official Journal. These quotas will soon be available through the usual tools, such as: RITA and QUOTA.
Not far from that, Tunisia validated the modernised rules on 31 December. In fact, the President of the Tunisian Republic has promulgated three so-called texts « Organic laws » which endorse the amendment of the EU-TN Agreement and therefore the acceptance of modernised rules of origin which become indispensable for trade between Tunisia and the EU.
