Authorised MACF registrant status: the application procedures are published!
On Tuesday 18 March, the European Commission published its Implementing Regulation on the conditions and procedure for the registration of importers as an authorised registrant in an Official Journal.
The Carbon Border Adjustment Mechanism (CBM) is the EU's most impacting measure for importers given its mandatory or prohibitive nature from 2026 onwards.
From 1 January 2026 only operators with the status of « declaring MACF authorised » may import goods covered by the MACF.
It was originally foreseen that the importers concerned would be able to apply for this status from January 2025. However, the portal is still not operational to date. Applications will be made on a new IT platform, separate from the transitional period register, which should beaccessible from the end of March 2025.
It is in this context thatImplementing Regulation No 2025/486, published by the EU, contains the requirements and procedures for filing applications.
For France, DGEC (Directorate-General for Energy and Climate) will be the authority responsible for processing applications. It will have 120 days to assess and confirm the status of the importer.
With no confirmation to date of the possible relaxations of the MACF regulation proposed in the EU's global Omnibus project (notation of minimum thresholds to be covered by MACF and of the management simplifications for the final period), we strongly recommend to all importers ofpreparing for filing the applicationof which you will find details inour ACTu of 24 October 2024.
