Reimbursement of IEEPA surcharges in the United States: US Customs Launches Processing Tool
Following the decision of the Supreme Court and the orders of Richard Eaton J. in March, the Customs and Border Protection Service (CBP) initiated the establishment of a refund mechanism within the United States Customs Portal (Automated Commercial Environment).ACE), called CAPE (Consolidated Administration and Processing of Entries).
This CAPE module is considered a claim process specifically designed for IEEPA tariff refunds. The key word here is « claim ». On 31 March, the CBP confirmed that the CAPE system has entered phase 1 and should cover approximately 63% of the import declarations covered by the surtax. The processing of accepted returns may take up to 45 days.
With regard to the arrangements for reimbursement, these must be the subject of separate requests from importers or brokers (equivalent to the customs representative registered in France), via a mandatory electronic registration in which bank details must be provided in advance.
In terms of the claim period, importers have 180 days after liquidation to file a dispute, since 53 million imports into the United States are covered by IEEPA, for about 330,000 importers.
It is recommended that companies that have been affected by surtaxes since last summer in the United States quickly file claims with their brokers in order to avoid longer processing times.
