REACH: ECHA recommends 7 new SVHC priority bans (Annex XIV)

On 5 February 2018, the European Chemicals Agency (ECHA) published its new recommendation for SVHC substances to be included in Annex XIV.

The following 7 chemicals (substances of very high concern – SVHC) are considered priority to the prohibition by ECHA:

Substance EC No CAS No
1,2-benzenedicarboxylic acid, di-C6-10-alkyl esters; 1,2-benzenedicarboxylic acid, mixed decyl and hexyl and octyl dieters with ≥ 0.3% of dihexyl phthalate (EC No. 201-559-5)
271-094-0

272-013-1

68515-51-5

68648-93-1

1-Methyl-2-pyrrolidone (NMP) 212-828-1 872-50-4
2,4-di-tert-butyl-6-(5-chlorobenzotriazol-2-yl)phenol (UV-327) 223-383-8 3864-99-1
2-(2H-benzotriazol-2-yl)-4,6-diertpentylphenol (UV-328) 247-384-8 25973-55-1
2-(2H-benzotriazol-2-yl)-4-(tert-butyl)-6-(sec-butyl)phenol (UV-350) 253-037-1 36437-37-3
2-benzotriazol-2-yl-4,6-di-tert-butylphenol (UV-320) 223-346-6 3846-71-7
5-sec-butyl-2-(2,4-dimethylcyclohex-3-en-1-yl)-5-methyl-1,3-dioxane [1], 5-sec-butyl-2-(4,6-dimethylcyclohex-3-en-1-yl)-5-methyl-1,3-dioxane [2] [covering any of the individual stereoisomers of [1] and [2] or any combination thereof] (karanal group)

Dihexyl phthalate (EC: 201-559-5) and NMP are considered to be hazardous to health (toxic to reproduction). The other 5 substances, UV-328, UV-327, UV-350, UV-320 and karanal, have environmental effects (vPvB, PBT).

The final decision to include these substances in Annex XIV to REACH, as well as the date from which companies will have to apply for ECHA authorisation, will soon be taken by the European Commission in collaboration with EU Member States and the European Parliament.

RECALL

The European REACH Regulation requires all manufacturers and importers of substances (including substances imported in the form of mixtures) to register more than 1 tonne per year with the European Chemicals Agency (ECHA).

The most dangerous substances (e.g. CMR) and manufactured or imported at more than 100 tonnes/year must already be registered in order to be placed on the market.

The REACH Regulation provides for three registration deadlines for pre-registered substances. The final deadline of 1 June 2018 is for substances manufactured or imported in very small quantities (between 1 and 100 tonnes/year).

If they were not registered before 1 June 2018, they will no longer be placed on the market. This deadline mainly concerns small businesses.
