REACH: Increase in fees for applications for authorisation

A review to cover case management costs, justified by the large number of different uses requested by applicants.

In order not to have a sharp impact on the European economy, ECHA had provided for a temporary alternative from the start of the REACH Regulation which would allow the companies concerned to apply to the Commission.authorisation to continue the use of substances of high concern in their products.

Cost, limited in time, requiring proof of absence of substitute substances, and proving the prerogative of the interest of the product on the risk of health and environmental impact, the application for authorisation was to allow the high-tech industries (e.g. aeronautical, space, automotive...) to have the time to carry out R&D operations in order to guarantee the quality and conformity of their products with new combinations of substances.

The fees and licensing fees therefore have two main objectives:

  • Cover case management costs by ECHA
  • To encourage industrialists to find substitute substances

They are calculated according to a scale covering three main criteria:

  1. Number of applicants
  2. Number of substances
  3. Number of uses per substance

From the outset, a tariff schedule was applied, consisting of: Standard rate applicable to all undertakings, and reduced rates for TPE/SME and micro enterprises.

Two major changes have been made to the fee schedule since mid-July (see details below):

  • Cancellation of fees per additional applicant
  • Strong increase in royalties per additional use

Beyond these figures, these are also the rules for the allocation of fees when applying for joint authorisation:

  • The highest fee will be applied to the group of applicants (regardless of the size of the undertakings which make up it)
  • The group will be billed (only 1 invoice)
  • All members of the group will have to share the cost equitably (regardless of the size of the enterprises)
