For industrial manufacturers or importers of substances or preparations (mixtures of substances) of more than one tonne per year, it is now the strict application of a regulation based on a simple principle: « no data, no market ».
In other words, any chemical requires registration with ECHA before it can be manufactured, distributed, processed or sold on European territory.
Ten years have been needed to establish strict safety rules, build effective management tools, promote safer products for health and the environment.
In total of the 3 deadlines that closed the 4 main stages of the REACH deployment schedule, these are: more than 20,000 registered substances(*) at European level, for 80 000 cases submitted by companies.
Immediate impact of the application for authorisation for Annex XIV substances (prohibited substances) : many industrialists have reviewed their « income » to eliminate the most toxic substances from products and preparations.
Finally, many restrictions have been included in Annex XVII, imposing in particular strict requirements in terms of marking, labelling and packaging.
However, the real entry into force of the REACH regulation only begins now!
As the pre-registration procedure is finally closed, it is now necessary to register directly and anticipate the costs and deadlines before placing on the market.
Attention: manufacturers, importers, distributors or users... you are all jointly and severally responsible for the obligation to use, manufacture or distribute in the European Union duly registered chemicals. Otherwise, you can be convicted for illegal use of a chemical!
