ICS2: safety/safety declarations win road and rail transport

On Monday, 10 March, the International Trade Branch of Customs organized a new webinar on the deployment of cargo security/security formalities. The ICS2 system, which is in place for the air and maritime sectors, is entering its deployment phase for the road and rail sectors from the1 April 2025and until1 September 2025, the date on which all operators concerned must pass through the ICS2 system.

New flows impactedare: unaccompanied trailers (trailers placed alone, without their tractor, on board a ship), combined transport « RO-RO » (trailers embarking with their tractor), combined road transport (rail truck), conventional rail transport and conventional road transport.

As a reminder, ICS is a central system to which all EU carriers connect to file ENS (Entry Summy Declaration).

ENS is a mandatory summary entry declaration which prevents the arrival of a third party goods on the TDU (Union Customs Territory). This declaration allows for risk analysis and the targeting of customs controls even before the goods are the subject of a customs declaration (i.e. even before a customs procedure is assigned to a goods).

Depending on the mode of transport, the data set to be reported in the ENS and the deadlines for filing the declaration are different. This ENS declaration is the first link in the computer link to the arrival of a third party commodity on the TDU.

It follows a first step of notification in the ANTES system (French system) which allows the presentation of the goods before assigning them a temporary deposit scheme type IST(Temporary storage facility) or LADT (Accredited places for temporary storage).

During its intervention, the customs authorities ensured that explanations were as precise as possible despite the complexity of the subject. Thewebinar replayallows us to understand the link that takes place between the various customs clearance procedures to meet SAFE safety/security standards through the CDU (Union Customs Code).

Attention, regarding exchanges with the United Kingdom across the smart border, the process will be simpler once the carriers have integrated the ELO (Logistics Envelope) system which will be inseparable from the ICS2 application (see our article of 20 February 2025:BREXIT and smart border: evolution for the passage of goods between France and the United Kingdom).
