Theheadings 3208, 3209, 3210are specifically concerned with paint preparationsin the context of a use primarily for painting a support: paintball balls, which are paint capsules serving as a « impact markers », therefore, cannot enter into this framework.
One might logically believe that these fake ammunition used as part of a game be considered, under heading 9503, like « Parts and accessories » (NC* 9503 00 99) of »toy weapons » (NC 9503 00 81): Watch the trap!
Indeed, the Explanatory notes Chapter 95 clearly exclude »Weapons, ammunition and parts and accessories thereof« of the Chapter 93... Gold the ball thrower used in paintball can only be classified under code CN 9304 00 00 « Other weapons (fuses, rifles and spring, compressed air or gas pistols ...) » because of the high ejection speed at the exit of the gun!
Our paintball balls, despite their playful use, therefore fall under theCN code 9306 90 90under the heading « Bombs, grenades, torpedoes, mines, missiles, cartridges and Other ammunition and projectiles, and parts thereof [...]« .
