EU US trade: Commission formalises Turnberry agreement

The Turnberry Agreement is a trade arrangement concluded on 27 July 2025 between the European Union and the United States. It aims to ease transatlantic tariff tensions, which have emerged after several years of unilateral increases in US tariffs.

Unlike a conventional free trade agreement, the Turnberry Agreement is not a legally binding treaty between the parties. This is a political declaration that must be relayed, in each of the two legal systems, by legislative or regulatory implementing measures.

It is therefore done with the publication of the Regulation (EU) No 2026/1455which provides for the adjustment of customs duties and the opening of tariff quotas for certain goods originating in the United States. This Regulation entered into force on 1 July 2026 and will apply until 31 December 2029.

In order to clarify the application of the Regulation, the French customs administration communicated last week on the implementing rules with the Note No 26000125 of 30 June 2026. Important points to note:

  • To qualify for the exemption from customs duties on imports from the United States, a tariff preference must be sought in the customs declaration.
  • The conditions of application are based on the non-preferential origin of the imported goods, i.e. on the basis of the Union Customs Code exclusively through the rules of lists which define the « Made in » a product.
  • Proof of origin must be provided by the importer by all means; In other words, no evidence of origin from US exporters is requested.
