On 20 February, Regulation (EU) 2024/573 was published in the Community Official Journal, laying down rules for the containment, use, recovery, recycling, regeneration and destruction of wastefluorinated greenhouse gases. This Regulation imposes conditions for the production, import and export of fluorinated greenhouse gases and certain products and equipment containing these gases.
In order to implement this new regulation, DGDDI (Directorate-General for Customs and Indirect Duties) has created specific tariff provisions relating to customs nomenclatures concerning products or materials which may be affected by the regulations.
At the time of customs declarations, special tariff provisions will have to be used in order toserve at customs if the products are concernedby that regulation and, if so, whether the importer holds an import permit or an authorisation to place those products on the market.
Recall that the EU has set itself the goal of reducing its GHG emissions by at least 55% by 2030 and achieving carbon neutrality by 2050 (cf.Green Deal EU: Carbon Market Reform to come into force). The European Commission has proposed phasing out fluorinated or hydrofluorocarbons (HFCs). While these gases do not damage the atmospheric ozone layer, they are powerful greenhouse gases (GHGs) with even higher warming potential than CO2.
