Counterfeiting: Payment of the processing costs of the customs administration on 01/01/2019
The order of 11 December 2018 published in OJRF No 0295 aims to specify the procedures for calculating the costs of storage, handling, transport and destruction of goods suspected of being infringing.
Since 1 January 2019, the French customs administration has requested right holder reimbursement of management, storage, handling, transport and, where appropriate, destruction costs goods suspected of being infringing (according to Regulation (EU) No 608/2013 or Intellectual Property Code).
The rates are as follows:
- Care costs : 30 euros
- Storage costs* : 40 euros
- Destruction costs : 60 euros (20 euros up to 20 kg)
Where the declarant or the holder of the goods stores the goods held free of charge, no storage fee will be charged by the administration.
On the other hand, in the event of the destruction of goods within the framework of the simplified destruction procedureno refund will be claimed from the right holder.
On an exceptional basis, in the event of a specific benefit entailing an additional cost to the customs administration, a invoicing at actual costs is established by the administration.
