If one of these substances is present in any of its articles or products, the producer or importer shall be obliged to do so. notify the European Chemicals Agency (ECHA), if the following two conditions are met: :
- The substance is present in the article at aweight/weight concentration greater than 0.1%.
- The total quantity of substance used and greater than or equal to1 tonne per year.
The maximum notification period is 6 months on the official date of inclusion of the substance in the candidate list.
Notifications are to be submitted online via REACH-IT.
In addition, suppliers (manufacturers, importers, distributors, etc.) of articles containing a SVHC substance in a concentration > 0,1% (m/m) must provide information « sufficient » for the safe use of the article to the addressees of the article.
The notification to ECHA therefore does not exclude the obligation toconsumer information upon request, within 45 days of receipt of the request.
